Terms Of Use
1.1 Welcome to eMAG. Access to and
use of eMAG’s Web site are subject to the following
Terms of use. Please read and understand these Terms
of Use ("Terms") carefully. Creating an account
with eMAG will signify your acceptance of these Terms
and constitute a binding agreement between you and eMAG
("Agreement").
1.2 The eMAG Service (“Service”) is the
on-line service operated by Nanyang Online Sdn Bhd (NOL),
including the eMAG Web site/(s), that provides you with
the capability to order and subscribe to various magazines,
and read the digital versions of those publications
or products online.
1.3 When you register as a member, you
will need to provide your user name and password and
other information. We discourage you from adopting false
persona, identities or characteristics. You most provide
true, accurate, current and complete information about
yourself when you register with eMAG, and to maintain
and promptly update that information to keep it true,
accurate, current and complete. You are responsible
for maintaining the confidentiality of your account
and password and for restricting access to your computer,
and you agree to accept responsibility for all activities
that occur under your account, including the selection
and use of all content and services.
1.4 The Service is controlled, operated
and administered by NOL from its office in Malaysia.
If you access the Service outside Malaysia, the use
of the Service is subject to local laws. NOL’s responsibilities
is to make available the Services on this Website. As
such, you shall:
a) Be solely responsible for the set-up, configuration
or compatibility of your own hardware, equipment and
software for access to the Services and shall provide
at your own expense all facilities or resources necessary
for such proper access to the Services including without
limitation power points, electricity, conduits, access,
license;
b) Comply with the rules of any network through which
you accesses the Services; and
c) Be solely responsible for all information retrieved,
stored or transmitted through the Services by you.
1.5 As a responsible user of the Services,
you agree to :
a) Access the Services only via you Account, by using
your user name and password;
b) Take all such measures and steps as may be necessary
(including but not limited to changing your password
from time to time and choosing non-obvious passwords)
to prevent unauthorized use of your Account;
c) Notify NOL if you become aware of or reasonably believe
that there is any unauthorized use of you Account or
any other breach of security, and to co-operate with
NOL in all such investigations.
1.6 Due to the cost of maintaining inactive Accounts,
NOL reserve the right to delete your account if we detect
that there is continuous inactivity in your account
for six consecutive months after the date of last access
without prior notices.
1.7 All content, such as text, graphics,
logos, button icons, images, as well as the compilation
thereof, and all software used on this site, is the
property of NOL or its suppliers. You agree to abide
by all copyright notices. Each third-party content provider
owns the copyright on content original to it including,
without limitation, on the magazines and other publications
made available to you by the Service (the "Publications").
Except as permitted by the Publication's lawful owner,
you acknowledge that you do not acquire any ownership
rights by downloading copyrighted material, you may
not modify, reverse engineer, publish, transmit, display,
participate in the transfer or sale, create derivative
works, or in any way commercially exploit or provide
to a third party the content of the eMAG Web site, the
Publications, or any portion of them without the express
permission of eMAG and the copyright owner.
1.8 eMAG is a distributor (not a publisher)
of the Publications or other content supplied by third
parties. Accordingly, we have no editorial control over
such content. Any opinions, advice, statements, services,
offers or other information or content expressed or
made available by third parties, including those made
in Publications offered by the Service, are those of
the respective author(s) or publisher(s) and not of
eMAG. eMAG does not guarantee the accuracy, completeness
or usefulness of any content, nor will we be liable
for any loss or damage caused by your reliance on information
obtained through the Service.
2. Privacy Policy
2.1 eMAG collects information from
our users for a number of reasons, the chief
one being to better understand you and your needs to
improve our services. We know that you care how information
about you is used and shared, and we appreciate your
trust that we will do so carefully and sensibly.
2.2 We receive and store information when
you enter our Web site
* Registration data: When you register with eMAG, you
will need to provide basic contact information such
as your name, address, and email address and etc.
* Voluntary information: We may collect additional information
at other times, including but not limited to, when you
provide feedback, change your content or email preferences,
respond to a survey, or communicate with eMAG Customer
Support.
2.3 eMAG uses this information to:
* Verify access to secure content and your account information
* Determine whether you meet the minimum system requirements
for use of the Service
* Provide you tailored content and instructions, and
targeted promotions
* Service your customer support requests
* Better understand, on an anonymous and aggregated
basis, how the Service is being used, including Web
traffic and reading patterns, so that we may continually
improve our products and services
3. Termination
3.1 Either eMAG or you may terminate
this Agreement at any time. Without limiting the foregoing,
eMAG may, in its sole discretion and without liability,
terminate your password, or use of the Service for any
reason without limitation, if eMAG believes that you
have violated or acted inconsistently with the letter
or spirit of these Terms. Any termination of your access
to the Service under any provision of these Terms may
be effected without prior notice, and eMAG may immediately
deactivate or delete your account and all related information
and/or bar any further access to the Service.
4. Notification Of Changes
eMAG shall have the right at any
time to revise this Privacy Policy to keep it up to
date with eMAG's services. The update data is used to
alert you to recent changes. If changes to eMAG's privacy
policy will directly affect how we share your Personal
Information, we will notify you by posting a notice
on our Web site or by sending you an email and giving
you an opportunity to opt out of such change. Unless
we notify you otherwise, our collection and use of your
Personal Information is governed by the privacy policy
in effect at the time such Personal Information is collected.
